Eligibility

By placing an order, you confirm that you are at least 18 years old, legally capable of entering into binding contracts, and that the information you provide is accurate and complete.

Fulkrum™ products are developmental support tools designed through clinical practice and intended for use only as described in the instructions provided. They are not medical devices and do not replace professional medical advice or treatment.

Physical products are intended only for babies within the specified age and weight limits. Misuse, modification, or failure to follow instructions voids all warranties and releases Fulkrum™ from liability.

Digital products, including eBooks, guides, and downloads, are for informational and educational purposes only. They are not a substitute for medical advice or treatment and should be used at your own discretion.

Product Use and Disclaimer

Orders and Acceptance

All orders are subject to acceptance by Fulkrum™. We may decline or cancel any order if we cannot guarantee delivery, if product availability is limited, or if there are errors in pricing or product information.

Shipping and Delivery (Physical Products)

We are launching Fulkrum™ products in phases to ensure reliable supply chains and clinical safety. Shipping availability depends on your location and will be communicated before checkout.

Delivery times provided are estimates. While we aim for timely delivery, delays may occur due to customs, carrier, or regional availability. Risk of loss passes upon delivery to the shipping address you provide.

Digital Products (eBooks, Guides, and Downloads)

Digital products are delivered electronically via email or direct download link immediately upon successful payment. No shipping fees apply.

Digital products are non-refundable once accessed, downloaded, or delivered to your device, except where required by law. In the rare case of technical issues or defective files, please contact us for assistance at

Digital products may be distributed or fulfilled via third-party platforms (such as Shopify or Lemon Squeezy), which may process user data necessary for payment and delivery.

By completing your purchase, you expressly agree that access to the digital product will begin immediately and acknowledge that you lose your right to withdraw once the download or access process begins.

Returns, Warranty, and Digital Product Policy

Returns are accepted within 7 days of delivery, provided products are unused and in their original packaging. Fulkrum™ covers return shipping through its regional logistics partners.

Refunds for digital products are handled directly by the Merchant of Record according to their refund policy. Please refer to Lemon Squeezy's Terms of Sale for details.

Fulkrum™ warrants products against defects in materials and workmanship for a period of 6 months from delivery. This warranty does not cover normal wear, misuse, or damage resulting from failure to follow instructions.

Digital products are non-refundable once accessed, downloaded, or delivered. No warranty applies to compatibility with specific devices, software, or operating systems. Fulkrum™ makes no guarantees that digital files will be error-free or available without interruption.

Pricing and Payment

All prices are listed in the currency shown at checkout and include applicable taxes unless stated otherwise. Fulkrum™ reserves the right to change prices at any time. Payment is required in full at the time of order.

Payments for digital products are securely processed by Lemon Squeezy, Inc. as the authorized Merchant of Record. The Merchant of Record is responsible for billing, payment processing, and tax compliance, including VAT/GST where applicable.

Fulkrum™ (Babycare & Beyond Sdn. Bhd.) does not collect or store payment information directly.

Limitation of Liability

To the maximum extent permitted by law, Fulkrum™'s total liability will not exceed the purchase price of the product giving rise to the claim. Fulkrum™ is not liable for indirect, incidental, or consequential damages arising from product use.

Parents and caregivers are responsible for ensuring that physical products are used in accordance with all instructions and warnings.

Fulkrum™ makes no warranty that digital products will be error-free or compatible with all devices or software versions. You agree that your use of digital content is at your sole risk.

Intellectual Property

The Fulkrum™ wordmark is a registered trademark in the United States and the European Union. The Core product is protected under patent rights in Malaysia, with additional patent and design registrations to follow in other jurisdictions. Future Fulkrum™ products, including our baby carrier, will also be covered by intellectual property protections as filings are granted.

When purchasing a digital product, you are granted a personal, non-exclusive, non-transferable license to access and use the content for private, non-commercial purposes only. Redistribution, resale, modification, or publication of this material in any form is strictly prohibited.

All content on the Fulkrum™ website, including text, graphics, product designs, logos, and images, is the property of Babycare & Beyond Sdn. Bhd. or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws.

Our trademarks, patents, and product designs may not be used, reproduced, or copied, in whole or in part, without our prior written consent. Unauthorized use will be enforced to the fullest extent of applicable law.

Changes to Terms

We may update these Terms from time to time. Updates will be posted on our website with the revised effective date. Continued use of our site or purchase of products after changes are posted constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.

Fulkrum™ is not responsible for any failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, labor disputes, transportation disruptions, supply chain interruptions, acts of war, terrorism, or government actions. Where such events occur, our obligations are suspended for the duration of the disruption.

Force Majeure

Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and Babycare & Beyond Sdn. Bhd. regarding your use of our site and purchase of our products, and supersede all prior agreements or understandings.
